When we’re younger we often feel invincible – as if we’ll live forever. We don’t think about preparing a Last Will and Testament until we’re prompted by a certain event in our life such as a death in the family, a medical crisis, or even taking a long-distance vacation. But it’s never to soon to be prepared – every adult should be thinking about their estate plan. And drafting a will should not be taken lightly, it’s very important business.
A will (Last Will and Testament) is a legal document that allows a person to make several important decisions and designations that become effective upon their death, such as:
Who will raise your minor children after your death?
Who will receive the property and assets that pass through your probate estate?
Will your heirs receive their property outright or in a trust?
Who will serve as your personal representative to assist in the administration of your estate during the probate process?
There are several important considerations that must be addressed when preparing a will – protecting the rights of family members, avoiding conflicts and challenges among the heirs, preserving assets for children of a prior marriage, the need for trust provisions within the will, choosing suitable personal representatives and trustees, avoiding undesirable tax consequences, jeopardizing an heir’s eligibility for Medicaid or other public benefits, and ensuring proper execution to ensure the document is legal, just to name a few.
Even people with minimal assets should have a will. Remember that certain claims can arise as the result of your death, which could cause assets to be added to your estate – damages paid in connection with an automobile accident or wrongful death claim could cause significant assets to be added to your estate. It’s important to have the appropriate will or trust in place to address the management and disposition of these assets.
